In this Privacy Policy, “Astrology Jennifer,” “we,” “our,” and “us” refer exclusively to FABEXS SERVICES SAS, the sole legal entity operating the Astrology Jennifer brand and the data controller within the meaning of Article 4(7) GDPR.

2. Scope of This Policy

This Privacy Policy describes how FABEXS SERVICES SAS collects, uses, stores, and protects personal data in connection with: (a) subscriptions to the Astrology Jennifer email newsletter and promotional communications; (b) purchases of digital products (natal charts, readings, transit reports, PDFs, audio, video, and online content); and (c) interactions with our sales pages, order forms, and landing pages.

This Policy applies to all individuals who subscribe to our communications or purchase our products, regardless of their country of residence.

4. Information We Collect

4.1 Information You Provide Directly

When you subscribe to our newsletter or purchase a product, we collect:

  • Email address (required for all subscriptions and purchases)
  • First and last name (where provided)
  • Billing information (transmitted directly to our payment processor — we do not store full card data)
  • Billing address (country, state/region, postal code)

4.2 Astrological Product Data

For personalized digital products, we collect the information you voluntarily provide to enable personalization:

  • Date of birth
  • Time of birth (where provided)
  • Place of birth (city and country)
  • Optional personal background (marital status, professional situation, family situation — provided voluntarily to contextualize the reading)

4.3 Email Behavioral Data

When we send you emails, our email service provider (ESP) may collect whether and when an email was opened, links clicked, email client type, device type, and approximate geographic location derived from IP, as well as bounce and deliverability events. You may disable email open tracking by configuring your email client to block remote image loading.

4.4 Transaction and Purchase Data

Order reference number, purchase date, product(s) purchased, amount paid, payment authorization result, and refund or chargeback history. No raw card data is stored by us.

4.5 Technical and Log Data

When you interact with our sales pages, we may collect standard web server log data including IP address, browser type, referring URL, and page interaction timestamps. This data is used for security, fraud prevention, and basic analytics.

5. How We Use Your Information

  • Delivering the products or content you have purchased or requested
  • Sending the Astrology Jennifer newsletter and promotional campaign emails (where you have subscribed)
  • Personalizing astrological digital products using the birth data and background information you provide
  • Processing payments and managing billing, refunds, and chargebacks
  • Responding to customer support and refund requests
  • Segmenting our email list to send more relevant communications
  • Maintaining list hygiene — managing unsubscribes, bounces, and suppression lists
  • Complying with legal obligations (accounting, tax, regulatory requests)
  • Preventing fraud and unauthorized transactions
  • Defending our legitimate interests in case of disputes or legal proceedings

6. Legal Bases for Processing (GDPR)

For subscribers and customers located in the European Economic Area or otherwise covered by the GDPR, the following legal bases apply:

  • Contract performance (Art. 6(1)(b)): Delivery of purchased digital products, personalization, payment processing, and post-purchase customer support.
  • Legitimate interests (Art. 6(1)(f)): Email engagement tracking for list segmentation, fraud prevention, list hygiene, retention of data to defend against legal claims, and basic security monitoring.
  • Consent (Art. 6(1)(a)): Sending the newsletter and promotional emails (opt-in at subscription, withdrawable at any time); email open tracking where CNIL guidance requires explicit consent (French residents).
  • Legal obligation (Art. 6(1)(c)): Accounting records and invoice retention (French accounting law: 10 years); responding to regulatory or law enforcement requests.

7. How We Share Your Information — No Sale of Personal Data

We do not sell your personal data. We do not share your personal data with third-party advertisers or data brokers. We do not use your email address or personal data for cross-context behavioral advertising.

We share personal data only with the following categories of third-party service providers, acting as data processors under contract with FABEXS SERVICES SAS:

  • Email Service Provider — Mailxpertise: Email delivery, list management, segmentation, behavioral tracking — France (EU), GDPR compliant
  • Hosting / Infrastructure — Amazon Web Services: Website and landing page hosting, content delivery — Europe

We may also disclose personal data: (a) to comply with a legal obligation; (b) to protect our rights, property, or safety; (c) in connection with a merger, acquisition, or sale of substantially all of our assets, provided the acquiring entity agrees to be bound by equivalent privacy obligations.

8. Email Marketing and CAN-SPAM Compliance

8.1 Consent and Subscription

We send commercial email communications only to individuals who have affirmatively opted in. Each opt-in record includes the timestamp, source, and version of the consent text displayed at time of subscription.

8.2 CAN-SPAM Act Compliance

All commercial email communications comply with the CAN-SPAM Act (15 U.S.C. § 7701 et seq.):

  • Each email clearly identifies Astrology Jennifer / FABEXS SERVICES SAS as the sender
  • We do not use deceptive or misleading subject lines
  • Each commercial email includes our physical postal address: FABEXS SERVICES SAS, 128 rue La Boétie, 75008 Paris, France
  • Every commercial email includes a clearly visible unsubscribe link
  • Unsubscribe requests are processed within 10 business days
  • We do not require payment or any other barrier to process an unsubscribe request

8.3 How to Unsubscribe

You may unsubscribe at any time by: (a) clicking the unsubscribe link in any commercial email; or (b) emailing unsubscribe@astrology-jennifer.com with subject line “Unsubscribe”. Transactional emails may continue until any open transaction is complete.

9. Email Tracking Technologies

9.1 How Email Tracking Works

Our email service provider (Mailxpertise) embeds a small transparent image (tracking pixel) in commercial emails. When you open an email with image loading enabled, your email client requests the image from our ESP's servers, allowing us to record the open event. We also use click tracking: links in our emails are routed through our ESP's servers to record which links are clicked and when.

9.2 Your Options

  • Open tracking: you can disable it by configuring your email client to block automatic loading of remote images.
  • Click tracking: cannot be selectively disabled. If you prefer no click tracking, your alternative is to opt out of email communications entirely.
  • Full opt-out: unsubscribing removes you from all commercial communications and therefore from all associated tracking.

9.3 CNIL Guidance — French Residents

The CNIL published draft guidance in June 2025 indicating that individual-level email open tracking pixels may require explicit consent for French residents under the ePrivacy framework. FABEXS SERVICES SAS is monitoring this guidance closely and will implement any required consent mechanism when the guidance is finalized.

10. Data Retention

  • Active subscriber data: Duration of active subscription + 36 months after last engagement — then anonymized or deleted
  • Customer purchase data (order records): 7 years from purchase date (French accounting law) — then anonymized or deleted
  • Astrological product personalization data: Duration of subscription + 24 months — deleted upon request or expiry
  • Email behavioral data (opens, clicks): 36 months from last event — then aggregated or deleted
  • Consent and opt-in records: 5 years after unsubscribe — then archived then deleted
  • Unsubscribe and suppression records: 5 years after unsubscribe — suppression list maintained
  • Accounting / transaction records: Per French Code de Commerce Art. L123-22 — then archived then deleted

11. International Data Transfers

FABEXS SERVICES SAS processes data within the European Economic Area as its primary location. Where personal data is transferred to third countries outside the EEA, we apply the following safeguards:

  • Standard Contractual Clauses (SCCs): EU Commission SCCs adopted under Implementing Decision 2021/914 (Module 2: Controller-to-Processor)
  • EU-US Data Privacy Framework: Where a US recipient is certified under the EU-US DPF, we may rely on that adequacy mechanism
  • Transfer Impact Assessments: For transfers to the USA, we assess the legal environment and implement supplementary measures where required

12. Your Rights

12.1 Rights Under GDPR (EEA Residents)

We respond to requests within one month of receipt. This period may be extended by a further two months where requests are complex or numerous.

  • Right of access (Art. 15): obtain a copy of the personal data we hold about you
  • Right to rectification (Art. 16): correct inaccurate or incomplete data
  • Right to erasure (Art. 17): request deletion of your data where no legal basis for retention applies
  • Right to restriction (Art. 18): restrict processing pending resolution of a complaint or accuracy dispute
  • Right to data portability (Art. 20): receive your data in a structured, machine-readable format
  • Right to object (Art. 21): object to processing based on legitimate interests, including direct marketing
  • Right to withdraw consent (Art. 7(3)): withdraw consent at any time without affecting the lawfulness of prior processing
  • Right to lodge a complaint: with the CNIL (cnil.fr) or your local supervisory authority

12.2 Rights Under CCPA/CPRA (California Residents)

We voluntarily extend CCPA/CPRA-equivalent rights to California residents, processed within 45 calendar days:

  • Right to know what personal data we collect, use, and disclose (we do not sell personal data)
  • Right to delete personal data we have collected from you, subject to legal retention obligations
  • Right to correct inaccurate personal data
  • Right to opt out of sale / sharing: we do not sell or share personal data — no action required
  • Right to non-discrimination: we do not discriminate against individuals who exercise their privacy rights
  • Global Privacy Control: we recognize and honor GPC browser signals as an opt-out

12.3 Rights Extended to All Users

As a matter of our privacy policy, we extend access, correction, erasure, and unsubscribe rights to all subscribers and customers regardless of location. To exercise any of these rights, contact privacy@astrology-jennifer.com.

13. Data Security

We implement technical and organizational measures designed to protect personal data, including:

  • Encrypted transmission of data between your browser/email client and our service providers (TLS/SSL)
  • Access controls limiting personal data access to personnel with a documented operational need
  • Contractual requirements on all processors to implement security measures appropriate to the risk
  • Regular review of our data flows to identify and address unauthorized data replication or access
  • Documented incident response procedures, including breach notification obligations

14. Children's Privacy

Our services are directed exclusively at adults aged 18 and older. We do not knowingly collect personal data from individuals under 18. With respect to COPPA: our services are not directed at children under 13. Any such data identified will be deleted without undue delay. If you believe a minor has submitted personal data to us, please contact privacy@astrology-jennifer.com immediately.

15. California Residents — Supplemental Notice

Categories of Personal Information Collected: Identifiers (email, name, billing address, IP address), commercial information (purchase history), internet or electronic network activity (email open/click behavior, device type), geolocation data (city/region derived from IP), and personal information submitted for astrological product personalization (birth data, background).

Sources: Directly from you (subscription forms, purchase forms, product personalization forms) and automatically (email behavioral tracking, server logs).

Business Purpose: As described in Section 5 of this Policy.

Third Parties: Email service provider (Mailxpertise), payment processor, and hosting/infrastructure providers. No sale or sharing for advertising.

16. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify active subscribers by email at least 14 days before the changes take effect, update the “Last Updated” date, and maintain the previous version available upon request at privacy@astrology-jennifer.com.

Your continued subscription or purchase after the effective date of any material change constitutes your acknowledgment of the updated Policy.
